Reform and Integrity Act (RIA)
The 2022 Reform and Integrity Act
The RIA changed EB-5 investment thresholds, established reserved visa categories and strengthened requirements for regional centers, projects and fund management.
Reserved Visa Categories
20% is reserved for rural projects, 10% for high-unemployment areas and 2% for infrastructure projects. Check the current Visa Bulletin and applicable procedures to determine filing eligibility and visa availability. Reserved categories do not mean there will never be a waiting period.
Concurrent Filing
If adjustment-of-status conditions are met and a visa is available, an immigration attorney can assess concurrent filing of I-526E and I-485. Employment authorization and travel documents require separate applications. Filing alone does not grant permission to work or travel.
Investment Duration and Exit
Immigration investment-sustainment requirements differ from a project’s loan term or exit arrangements. Review applicable policy and project documents. Do not assume principal will be repaid after two years.
Planning for Children’s Ages
CSPA age protection depends on applicable rules, petition processing and visa availability, among other conditions. Obtain an immigration attorney’s assessment in advance. Filing I-526E alone does not mean a child’s age is automatically frozen.
